The Labor Court authorized, in an unprecedented move, the withdrawal of FGTS funds to pay legal fees owed by a worker to the company that sued him.
Daniel Chiode, partner at the firm Chiode Minicucci Littler, gave an interview to the newspaper Valor Econômico about the case, highlighting that the decision “opens a new perspective for the execution of fees and demonstrates a new position in relation to the way the FGTS is used”.
The case involves a worker who had his request for reversal of just cause denied and, therefore, was ordered to pay the legal fees.
