Our partner Daniel Domingues Chiode was invited by the JOTA portal to comment on the recent decision of the Regional Labor Court of the 2nd Region (TRT-2), which reaffirmed that there is no automatic guarantee of employment relationship for cyber sports participants.
Daniel highlighted the importance of an individualized analysis of cases, considering their specificities: "The great success was recognizing the particularities of a case and not simply looking at the person as having an activity within an amateur team that requires an employment relationship."
This decision establishes important parameters for situations involving organized activities, respecting the particularities of each case and promoting greater legal certainty, also emphasizing the limits of the review of facts and evidence in higher courts.
