When a post can cost you dearly: social media limits at work have never been more relevant

Marília Nascimento Minicucci, founding partner of Chiode Minicucci Littler, a specialist in Labor Law and a master's degree holder from USP, wrote a column in InfoMoney about the limits of social media use in the workplace, a topic that gains even more relevance with the imminent regulation of big tech in Brazil.

In the article, Marília highlights that social media posts can directly impact a company's reputation, requiring extra attention from organizations. She reinforces that clear and up-to-date internal policies, combined with ongoing training, are essential to mitigate risks and guide conduct consistent with institutional values.

Freedom of expression and the right to privacy are constitutional guarantees, but they are not absolute. A company can, however, establish limits when content posted by employees, even on personal profiles, compromises the organization's image or principles. In more serious cases, the CLT even provides for the possibility of dismissal for just cause.

Faced with new rules for platforms and a trend toward greater accountability, Marília warns that a thoughtless post can generate serious and lasting legal impacts.
